5. Procedure for Obtaining Clinical Establishment License in West Bengal

6. Penalties for Non-Compliance

West Bengal's 2017 Act prescribes some of the more substantial penalty figures among state clinical establishment laws:

Operating without registration and license

Whoever carries on a clinical establishment without registration and license is liable to a penalty which may extend to one lakh rupees, along with a further penalty of one thousand rupees for each day of operation without license, subject to a maximum of ten lakh rupees.

Knowingly serving in an unlicensed establishment

Whoever knowingly serves in a clinical establishment that is not duly registered and licensed is liable to a penalty which may extend to twenty-five thousand rupees.

Minor deficiencies

Contraventions resulting in minor deficiencies — ones that do not pose imminent danger to health or safety and can be rectified within a reasonable time — attract a penalty which may extend to fifty thousand rupees.

Injury or death of a service recipient

Where a clinical establishment's negligence or deficiency causes injury or death, the Commission may direct payment of compensation, and in cases of grievous injury or death, may order cancellation of license, closure, and property forfeiture. In case of death, compensation shall not be less than ten lakh rupees, with interim relief payable within 30 days.

Display of certificate

The valid registration certificate (provisional or permanent) must be prominently displayed at the premises at all times.

Non-transferability

Permanent registration/license:
