5. Procedure for Obtaining Clinical Establishment Registration in Haryana

Registration under the Haryana framework is a two-stage process — provisional registration followed by permanent registration.

Step 1

Apply for Provisional Registration

The applicant applies to the authority for a provisional certificate either in person, by post, or through the web-based online facility, along with the necessary information in the prescribed format (Annexure 1), accompanied by a fee of five hundred rupees. This provisional certificate allows the establishment to commence or continue operations while it works toward full compliance.

Step 2

Acknowledgement

On receiving the application, the authority (or a person authorised in this behalf) provides an acknowledgment slip immediately, which is delivered by post or online, as the case may be.

Step 3

Apply for Permanent Registration

Once the establishment is ready to demonstrate compliance with the minimum standards prescribed by the National Council for its category, the applicant applies to the authority for a permanent certificate — again in person, by post, or through the online facility — along with evidence of having met these standards, and the prescribed fee based on the size/category of the establishment.

Step 4

Inspection and Verification

The authority, either directly or through an inspection team, may visit the premises to verify the information submitted and assess compliance with minimum standards.

Step 5

Grant of Permanent Registration

If the authority allows the application, it issues a certificate of permanent registration containing the particulars prescribed under the Rules.

Step 6

Display of Certificate

Once issued, the registration certificate — whether provisional or permanent — must be prominently displayed at the premises of the clinical establishment, as required under the Act.

6. Penalties for Non-Compliance

Haryana's law prescribes fairly stringent consequences for operating without valid registration:

Closure orders

If the State Authority, after enquiry or on a report from the District Authority or an authorised officer, is satisfied that a clinical establishment is unregistered, or is carrying on business after cancellation of registration or despite a restraint order, it shall pass orders for immediate closure of such establishment along with a fine which may extend to fifty thousand rupees.

Continued violation after closure

Any person who continues to run a clinical establishment after such a closure order is punishable with simple imprisonment for a term extending up to two years, along with a fine which may extend to five lakh rupees.

General contraventions

The State Government may prescribe fines, not exceeding five lakh rupees, for contraventions of the Act or Rules for which no specific fine has otherwise been provided.

Delayed renewal

Where an application for renewal of provisional registration is not submitted within the stipulated period, the authority may still allow renewal on payment of the prescribed renewal amount, along with a penalty of fifty rupees per day until the date of renewal.

7. Post-Clinical Establishment Registration Compliances

Registration is not a one-time event; clinical establishments in Haryana are expected to maintain ongoing compliance, including:

Display of certificate

The valid registration certificate (provisional or permanent) must be prominently displayed at the premises at all times.

Non-transferability

The certificate of registration is non-transferable; any change in ownership or management typically requires fresh intimation or registration.

Maintenance of standards

The establishment must continue to meet the minimum standards of facilities, equipment, and qualified staff on the basis of which registration was granted.

Cooperation with inspections

Establishments must permit periodic inspections by the authority and provide reasonable facilities for such inquiries.

Reporting and returns

Establishments may be required to furnish periodic returns or information as directed by the authority.

Intimation of material changes

Any significant change in bed strength, services offered, location, or ownership structure generally needs to be reported to the registering authority.

Renewal within timelines

Applications for renewal (of provisional registration, and subsequently permanent registration) must be filed well before expiry to avoid penalties or lapse of registration.

8. Validity of Clinical Registration

Provisional Registration:

Generally valid for a limited initial period (commonly up to one year), during which the establishment is expected to work toward meeting the full minimum standards required for permanent registration.

Permanent Registration:

Once granted, permanent registration is valid for 5 years from the date the certificate is issued.

Operating beyond the validity period without renewal exposes the establishment to the penalties discussed earlier, including possible closure.

9. Renewal of Clinical Registration

Renewal of Provisional Registration: The clinical establishment must apply for renewal of its provisional registration within thirty days before the expiry of the validity of the provisional certificate.

Late Renewal: If the renewal application is not submitted within this stipulated period, the authority may still permit renewal, but on payment of the prescribed renewal fee along with a penalty of fifty rupees per day until the date of renewal.

Renewal of Permanent Registration: Since permanent registration is valid for a fixed term (currently five years), the establishment must apply for renewal in advance of expiry, following a process similar to the original application — including, where required, fresh evidence of continued compliance with minimum standards.

Consequences of non-renewal: Failure to renew on time can result in the establishment being treated as unregistered, attracting the closure orders and fines discussed in the penalties section.
